In the suit, the plaintiff alleges violations of the Securities Exchange Act of 1934 during this period by Keryx Biopharmaceuticals and the CEO of the company. Specific allegations include false and misleading statements by the CEO concerning the Phase 3 “X-PECT” clinical trial of the drug perifosine. The X-PECT trial was to evaluate the use of perifosine(KRX-0401) combined with capecitabine(Xeloda) to treat patients with refractory advanced colorectal cancer.

Between market close on Friday, March 30, 2012 and the following Monday, April 2, 2012, KERX shares plummeted from $4.98 to $1.74, continuing to a low of $1.28 posted on April 18, 2012. As of February 1, 2013, KERX shares had recovered to a closing price of $7.11 per share on NASDAQ.
