The class action suit states that the company failed to disclose relevant information about the company during this stated period because of the adverse effects the information would have on the company. For the 12 month period ending December 31, 2010, the company reported total revenue of $41.64 billion, with a net income of $155.6 million. For the 12 month period ending December 31, 2011, the company reported total revenue of $1.28 billion, with a net loss of $188.4 million.

On January 25, 2011, the company released its final financial results for the fourth quarter of 2010. At that time, the company did not disclose any relevant information that would allow shareholders to anticipate such a severe drop in revenue in the coming year. 

The financial report for the first quarter of 2011 was released on April 26, 2011. At that time, shareholders discovered that there were problems with the company. Stocks began to lose value at that time, plummeting to half their value by August of 2011. It is the belief of the shareholders that the company was already aware of the financial problems at the time they released their final report for 2010.
